Question: Ask The Nuwaupians, did you know that the transporting of minor across state lines was under the direction of Malachi York?

Answer: They will deny it because they don't know the details of the case. 

            

Nuwaupians are lost on 90% of the events and revelations that came out at the trial of Malachi York. Many Nuwaupians get a picture in their heads that York got into a van, took ALL the children at the same time and drove straight to Georgia to have sex,  and from that point of view they find it a bogus conviction.

That's not what happened. The testimonies of victims and witnesses reveal that there was a list of persons who would move from upstate NY to Eatonton, Georgia, and why.  Nuwaupians never get into this aspect of the York case for three possible reasons. 

1. They're outraged and too busy trying to deny that York had sex with minors,

2. They're obsessed with trying to connect Jacob York as the cause of his fathers downfall,

3. They're using the "Isle of Patmos" CD and Nuwaubian facts website as their sole source of information on the York case and trial.

 

These bias views of the York case is why Nuwaupians are blind to certain realities of why York was convicted on several counts.

This presentation of what was stated in court by those directly involved should shed light on the truth of the matter.  In addition to other charges, York was convicted of,


Conspiracy to Transport Minors in Interstate Commerce for Unlawful Sexual Activity; Conspiracy to Travel in Interstate Commerce for Unlawful Sexual Activity with Minors; and Conspiracy to Structure Cash Transactions to Evade Currency Transactions Reporting Requirements

Transporting Minors in Interstate Commerce for Unlawful Sexual Activity (04/1993) 9ss, 10ss, 11ss

Travel in Interstate Commerce to Engage in Unlawful Sexual Activity With Minors (1996) 7ss

 

All totalled, including other charges, resulted in York receiving 1,620 months.

240 months as to Ct. 122; 240 months as to Ct. 2ss; 60 months as to Ct. 3ss; 180 months as to Ct. 5ss; 180 months as to Ct. 7ss; 120 months as to Ct. 9ss; 120 months as to Ct. 10ss; 120 months as to Ct. 11ss; 

All Counts to run consecutive for a total sentence of imprisonments of 1,620 months.

 

Any photos or images of the victims and witnesses is not to disrespect, vilify, or degrade them in any way. It's intended to show the faces of those individuals who had the courage to come forth and tell what they knew and experienced first hand, despite knowing that they would be hated, ridiculed, labeled traders, threatened, and friends lost.  Having pictures of these victims helps to bring a reality to the minds of the reader, showing that these are real people and suffered at the hands and will of Malachi York.

 

Court Transcript December 30, 2003 pg. 2 LL 13-19:


“I will also tell you that I’m not going to have a closed trial. I have made arrangements to have a closed circuit television set up, and any spectators will be able to watch the trial of this case on the third floor by watching the monitor set up for closed circuit television, and I think that satisfies any public trial requirements under the Sixth Amendment or the First Amendment.”

During the course of the trial of this case, there were 40-50 spectators viewing the trial on close circuit television with the witnesses, inclusive of alleged victims or witnesses who would be under the protection of the Title 18, United States Code, Section 3509(d). The names and faces of victims and all witnesses in this case were witnessed by the 40-50 spectators or members of the public.

 

The following trial notes are from the York trial January 12, 2004:  Habiybah Washington 


Q. Ms. Washington, did Mr. York's sexual conduct with you continue in upstate New York?

Habiybah Washington: Yes.

Q. Did Mr. York's sex acts with you in Upstate New York also involve other girls about your age?

Habiybah Washington: Yes.

Q. Who were they?

Habiybah Washington: Nichole Lopez, Sakina Parham, Chandra Lampkin, Ebony Hill,

Q. How long after Mr. York's arrival in Georgia did you move to Eatonton?

Habiybah Washington: About a month.

Q. Were you part of the first group selected to move from Sullivan County to Eatonton, Georgia? 

 Habiybah Washington: I was part of the second group.

Q. You spoke about Sakina Parham, do you remember if she was one of the girls that moved to Eatonton with the first group?

Habiybah Washington: She came with the third or fourth group.

Q. How old was Sakina when you witnessed Mr. York performing sex acts on her?

Habiybah Washington: I believe she was 14.

Q. Where did this take place?

Habiybah Washington: It was in upstate New York.

Q. After you arrived in Eatonton, Georgia, did the defendant have a discussion with you about relocating other persons from upstate New York to Eatonton, Georgia?

Habiybah Washington: Yes, we went over a list of people still living up there.

Q. Please tell the jury about that discussion.

Habiybah Washington: Well we went over a list of each person that lived there, parents, children and he selected who was to come down next.

Q. How was this list compiled and who complied it?

Habiybah Washington: We would make the list.  At the time it was Kathy York and me making the list, it wasn't complete because at one point she made a list and I made a list.

   

Q. So who would make the final selection of person who was to leave upstate NY and move to Eatonton, Georgia?

Habiybah Washington: Well we gave the list to him [Malachi York] and he would check off who's to come in the next trip.

Q. Were people allowed to relocate to the Eatonton property without York's permission?

Habiybah Washington: Not that I know of.

Q. During this time when you were living in Eatonton and Mr. York had this list of people to move to the Eatonton property, did Mr. York express any concerns to you about Amala Noel?

Habiybah Washington: Yes, he wanted Amala to come down because he was not sure if Amala was still talking her mother about what was going on, so we brought Amala down.

Q. And when Mr. York told you that he wanted Amala to come to Eatonton was her mother Barbara allowed to come as well?

Habiybah Washington: Yes.

Q. Was this before or after Mr. York expressed his concerns that Amala might tell her mother?

Habiybah Washington: This was after.

Q. Did Krystal Harden also accompany Amala?

Habiybah Washington: Yes she did.

Q. Did David Noel come on the trip with Amala and Krystal?

Habiybah Washington: Yes he did.

Q. Was Issa M. Johnson another one of the children that Mr. York selected to move from upstate New York to Eatonton, Georgia?

Habiybah Washington: Issa came with his mother Kathy York.

Q. Did they come down to Eatonton earlier than the trip with Krystal, David and Amala?

Habiybah Washington: Yes, Kathy came on the same trip as I did.

Q. Did Mr. York express any concerns about Krystal before she arrived in Eatonton?

Habiybah Washington: He wanted Krystal close because he wasn't sure if Krystal was going to open her mouth either.

Q. Where was Mr. York living when you arrived in Eatonton?

Habiybah Washington: He was living in building 100.

Q. How long did he live in that building?

Habiybah Washington: For approximately a month and after that he moved into a trailer.

Q. So did Mr. York explain to you why it was necessary for children beginning at age 7, 8, 9, 10 or 11 to live separate from their parents on the York property?

Habiybah Washington: Not that I can remember.

Q. What about the men and women socializing together or marrying?

Habiybah Washington: The men and women didn't live together, and they didn't socialize either.

Q. What if someone living on the land were interested romantically with someone else, or if let's say a woman living on the Eatonton property wanted to get with someone, could they marry?

Habiybah Washington: No, that's how it was on the land, I don't know what people did outside the land.

Q. Who made the final decision about who was able to marry or mate with whom?

Habiybah Washington: People had to consult Doc [York] about it.

Q. What would happen if he disapproved of a choice?

Habiybah Washington: They they wouldn't be together.

Q. You mentioned that Mr. York moved to a trailer, how long did he live in that trailer on the property?

Habiybah Washington: For approximately a year.

Q. And during that time did you witness him performing any sex acts involving children in that trailer?

Habiybah Washington: Yes I did. 

Q. Did you witness him do any sex acts with Krystal Harden in that trailer?

Habiybah Washington: Yes I did.

Q. And how old was Krystal when you saw Mr. York doing sex acts with that child in that trailer?

Habiybah Washington: She was approximately 5 or 6 years old.

Q. Please describe for the members of the jury what you saw during the first incident.

Habiybah Washington: Krystal was performing oral sex.

Q. Was there anyone else in the trailer?

Habiybah Washington: Yes, Issa Johnson.

Q. And how old was Issa?

Habiybah Washington: I don't remember, but he was younger than Krystal.

Q. Did you see Mr. York perform any sex acts with Amala Noel in that trailer?

Habiybah Washington: Yes. 

Q. And how old was Amala when you first saw her sexually with Mr. York in that trailer? 

Habiybah Washington: She was about 8 or 9.

Q. Please describe for the members of the jury what you saw Mr. York do to her.

Habiybah Washington: It was anal and oral sex.

Q. How did Amala come to even be in his trailer on that occasion? 

Habiybah Washington: I would bring her to his trailer.

Q. How often did you witness Mr. York performing sex acts with Krystal Harden?

Habiybah Washington: It wasn't often with Krystal.

Q. What about Amala?

Habiybah Washington: With Amala it was often, maybe four times a month, then at times once a month, there was no set number of times.

Q. So you all moved to Eatonton, Georgia in what month and year?

Habiybah Washington: In February of 1993.

Q. So during the first six months of you arriving in Eatonton, you witnessed Mr. York engaged in sex acts with Krystal and Amala?

Habiybah Washington: Yes.

Q. You mentioned that Issa Johnson was present during the first incident that you saw involving Mr. York and Krystal in the trailer in Eatonton, did you see Mr. York in sex with Issa?

Habiybah Washington: Yes, oral sex.

Q. And how old was Issa at that time?

Habiybah Washington: 4 or 5.

Q. Did you ever see Atiyah Thomas inside Mr. York's trailer in Eatonton?

Habiybah Washington: Yes.

Q. Were you present when Atiyah came to Mr. York's trailer?

Habiybah Washington: Yes.

Q. Were there other girls present on that occasion?

Habiybah Washington: There were 3 people in the trailer. 

Q. Did Mr. York's sexual activities increase or decrease upon arriving in Eatonton, Georgia?

Habiybah Washington: It increased.

Q. During the time you lived in Eatonton, Georgia, did you take trips with Mr. York and others to Disney World?

Habiybah Washington: Yes.

Q. Do you remember how many trips you made with Mr. York to Disney World?

Habiybah Washington: Yes 5 trips.

Q. Did Mr. York take the girls that he had sex with to Disney World?

Habiybah Washington: Yes on 2 occasions.

Q. Did Husna and Hasnaa Evans ever go on those trips to Disney World?

Habiybah Washington: Yes they did.

 

In the testimony of Habiybah Washington she explained that under the specific instructions from York, the minors who were living in upstate, Sullivan County "Monticello, New York" were chosen to move to the newly acquired property in Eatonton where within a short span of time, the sexual activity with those minor would resume.  In a separate testimony a corroborating witness, Nichole Lopez would give her testimony about the relocation and what would shorty follow.

 

The following trial notes are from the York trial  January 8, 2004: Nichole Lopez 


Q. When did you ultimately move to Eatonton, Georgia?

Nichole Lopez: It was in January 1993.

Q. How old were you when you moved?

Nichole Lopez: I was 17 going on 18. It was in January and there was about 8 of us, with Doc it made 9 of us that came down with the first trip. 

Q. When you moved to Georgia, where on the property did you live?

Nichole Lopez: In the beginning all of us lived in the same house at building 100.  Doc slept in the master bedroom and we all slept in the den.  As more people moved down, then they started using the house up on the hill called 103.

Q. After you moved to Eatonton, Georgia did the sexual activity with Mr. York continue? 

Nichole Lopez: Yes.

Q. What would happen there?

Nichole Lopez: Basically the same thing that happened upstate but more frequently; vaginal and anal sex.  Different people were there at times, different girls, but essentially the same thing just more often.

Q. How old were you again?

Nichole Lopez: 17, it was in January where I would turn 18, this was around 1992/1993, 17 going on 18. It was about 8 of us, including him that came down the first trip.

Q. Mr. York accompanied you and the other girls on the trip across state-lines to Eatonton, Georgia?

Nichole Lopez: Yes.

Q. Anyone else?

Nichole Lopez: Yes, Hajar, his daughter, one of his wives who was also a Banat, there was, Jin Hee Bey, she was a Korean lady who was like one of his wives that was with us, a girl named Qiturah, she was about 16, she was sort of his wife, but not raised with us, she came with the Young Disciples, after she became involved with Doc and eventually had 2 children with him.

Q. How did you all get down here?

Nichole Lopez:  2 cars, he took one car with 4 people, and the other 4 people were in another van with his son Ishmael York.

Q. When you got to Georgia, did the sexual activity with the defendant continue?

Nichole Lopez: Yes, it was pretty much the same, but more frequently, vaginal, anal, oral.

Q. When he had vaginal sex with you, did he ejaculate?

Nichole Lopez: No, he wouldn't ejaculate. 

 

Nichole Lopez's corroborates the testimony of Habiybah Washington, which was that shortly after leaving the State of  New York to the State of Eatonton, Georgia, the sex with the minors continued, but that in Georgia, the sex became more frequent.  



The following trial notes are from the York trial  January 8, 2004: Khalid Eddington

 

Q. Where were you born?

Khalid Eddington: Brooklyn, New York.

Q. Where you born in one of Mr. York's communities?

Khalid Eddington: Yes I was.

Q. How old were you when you left Brooklyn to move to upstate New York?

Khalid Eddington: I believe I was 11

Q. Once you arrived in upstate New York, where did you live?

Khalid Eddington: I lived with the boys and men at that time.

Q. Did you see Mr. York in upstate New York?

Khalid Eddington: Yes I started seeing him more often there.

Q. Did your family eventually move to Eatonton, Georgia?

Khalid Eddington: Yes.

Q. How old were you when you moved there?

Khalid Eddington: I was 13.

Q. Where you with the first group to relocate to Eatonton?

Khalid Eddington: No we were the last to come

Q. Where did you live in Eatonton, Georgia?

Khalid Eddington: I stayed with the other boys.

Q. Did you ever go inside Mr. York's trailer?

Khalid Eddington: Yes.

Q. Did Mr. York behave sexually towards you?

Khalid Eddington: Yes he did.

Q. How old were you when this started?

Khalid Eddington: I was about 13.

Q. Can you describe what happened?

Khalid Eddington: When I walked inside the trailer, I made a left and I remember seeing Habiybah sitting, I'm not sure if she had her cloths on or off, but I remember we eventually had sex for a short time. Habyibah was giving me a blow job and Mr. York was standing by me jerking off and eventually got closer to me with his penis. He said it won't be considered gay if I sucked his dick, and eventually he just got closer and closer and I gave him a blow job.

 

This testimony by he victim Khalid Eddington follows the same pattern, They were in Brooklyn, moved to upstate New York and in 1993 moved to Eatonton, Georgia where the sexual activity increased. The relocation from upstate to Georgia with minors was crossing state lines for sexual purposes, because shortly thereafter, according to victims and witnesses, the sex became more inclusive and frequent.

It's these simple facts that helped to convict York on multiple counts.  But again, Nuwaupians won't take the time to investigate the actions by York with regards to the relocation and settling in Eatonton, where the sex with the minors would continue.
